$5M in damages filed over NYC jaywalking arrest

NEW YORK (AP) — Lawyers for an 84-year-old Chinese man who was arrested in New York for jaywalking have filed a claim for $5 million in damages alleging he was assaulted by police and had to be hospitalized for his injuries.

The claim was filed Monday against the New York Police Department and the city of New York by Chinese immigrant Kang Wong.

The claim alleges that officers pushed Wong against a wall, beat him and threw him to the ground, causing him to lose consciousness. Wong was hospitalized for his injuries and was bleeding from the head.

NYPD Commissioner William Bratton has said he isn't aware of any excessive force used by officers. He says witnesses claim the injuries occurred from a "fall to the ground." Bratton says police are investigating the incident.
