Ousted stop-frisk judge's lawyer fights order

NEW YORK (AP) — A lawyer for a judge removed from court cases challenging the New York Police Department's stop-and-frisk policy wants an appeals court to reconsider its order.

Attorney Burt Neuborne filed papers Wednesday with the 2nd U.S. Circuit Court of Appeals in Manhattan. He says he represents U.S. District Judge Shira Scheindlin (SHEER'-uh SHIND'-lin).

He is asking a three-judge panel to reconsider last week's order removing her from the case for allegedly running afoul of the code of conduct for judges.

The appeals court said she improperly arranged for the cases to be filed in a manner ensuring she would preside over them. It also said she made statements in media interviews that jeopardized the appearance of judicial objectivity.

Scheindlin had ruled in August that police officers sometimes carried out stop-and-frisk unconstitutionally.
