Suspect in upstate fatal shooting caught in NYC

SCHENECTADY, N.Y. (AP) — Authorities say a 24-year-old upstate New York man has been charged with second-degree murder for opening fire at a family gathering last month, killing a man and wounding the victim's brother.

Police in Schenectady tell local media that Emmanuel Martinez was captured Wednesday in Brooklyn by U.S. Marshals. He had been sought since the night of Aug. 30, when 24-year-old Jose "Mickey" Torres was fatally shot and his brother, 31-year-old Luis Gomez, was wounded.

Other charges filed against Martinez include attempted murder and assault. He was scheduled to be arraigned in Schenectady City Court Thursday morning.

Police aren't saying yet what prompted the shooting, which occurred during a backyard family party at the start of Labor Day weekend.

It couldn't immediately be determined if he had a lawyer.
